1. Acceptance of Terms

By accessing and using the services provided by My Health Shape ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Membership Agreement

Your membership with My Health Shape is subject to the following terms and conditions. By signing up for a membership, you acknowledge that you have read, understood, and agree to be bound by these terms.

2.1 Membership Types

We offer various membership types including Basic, Premium, and Elite memberships. Each membership type includes different benefits and access levels as described in our membership materials and website.

2.2 Membership Fees

Membership fees are due monthly in advance and are non-refundable except as specifically provided in these terms. All fees are subject to change with 30 days written notice.

2.3 Payment Terms

Payment is due on the same date each month as your initial membership date. If payment is not received within 10 days of the due date, your membership may be suspended until payment is received.

3. Facility Use and Rules

3.1 Hours of Operation

Our facility operates according to posted hours. Members with 24/7 access may use the facility outside of staffed hours but must follow all facility rules and regulations.

3.2 Equipment Use

All equipment must be used properly and safely. Members are responsible for returning equipment to its proper location after use. Misuse of equipment may result in membership suspension or termination.

3.3 Dress Code

Appropriate athletic attire and closed-toe athletic shoes are required at all times. Shirts must be worn in all areas of the facility. We reserve the right to refuse service to anyone not properly dressed.

3.4 Guest Policy

Guests must be accompanied by a member at all times and are subject to guest fees. Premium and Elite members receive guest privileges as outlined in their membership benefits.

4. Health and Safety

4.1 Medical Clearance

Members should consult with a physician before beginning any exercise program. My Health Shape is not responsible for any injuries that may occur as a result of participation in our programs or use of our facilities.

4.2 Assumption of Risk

By using our facilities and services, you acknowledge that physical exercise involves inherent risks and you assume all risks of injury or harm that may result from your participation.

4.3 Emergency Procedures

In case of emergency, members should immediately notify staff or call 911. Emergency contact information must be kept current in your membership profile.

5. Cancellation and Refund Policy

5.1 Cancellation Notice

Memberships may be cancelled with 30 days written notice. Cancellation must be submitted in writing to our front desk or via email to the address provided in your membership agreement.

5.2 Refund Policy

Membership fees are generally non-refundable. However, we may provide refunds in cases of medical necessity with proper documentation or if you relocate more than 25 miles from our facility.

5.3 Freeze Policy

Memberships may be frozen for up to 3 months per year for medical reasons or extended travel with proper documentation and advance notice.

6. Personal Training and Services

6.1 Personal Training Sessions

Personal training sessions must be scheduled in advance and are subject to our cancellation policy. Sessions cancelled with less than 24 hours notice may be forfeited.

6.2 Group Classes

Group fitness classes are included with Premium and Elite memberships. Class schedules are subject to change, and we reserve the right to cancel classes due to low enrollment or instructor availability.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices regarding the collection and use of your personal information.

8. Limitation of Liability

My Health Shape shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless My Health Shape, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our facilities or services.

10. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of any modifications.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
